If you do not agree to these Terms, please do not access or use the Site or Services.

1.1. By using the Site, purchasing a program, or accessing our content, you acknowledge that you have read, understood, and agreed to these Terms, along with our Privacy Policy, which is incorporated by reference.
1.2. If you are using the Site on behalf of another individual or entity, you represent that you have authority to bind them to these Terms.
1.3. We may update or modify these Terms at any time. Updates become effective immediately upon posting, with the “Last Updated” date revised accordingly.

Confident & Strong provides online coaching, fitness, mindset, and habit-change programs designed to support personal growth and wellbeing.
The Services may include digital courses, downloadable materials, video content, or group coaching sessions.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without prior notice.

3. Eligibility

To use our Services, you must:

Be at least 18 years old, or have the consent of a parent or legal guardian.

Provide accurate and complete information when creating an account or making a purchase.

Comply with all applicable laws and regulations of Mexico and your local jurisdiction.

4. Payments, Refunds & Cancellations

4.1 Payments:
All prices are listed in U.S. Dollars (USD) unless otherwise stated. Payments are processed securely through third-party processors (e.g., Stripe, PayPal). You agree to provide accurate payment information and authorize charges for purchased Services.

4.2 Refund Policy (30-Day Guarantee):
We stand behind our programs and want you to be fully satisfied.
If, within 30 days of purchase, you are not satisfied for any reason, you may request a full refund by emailing [email protected] with your order details.

To qualify for a refund:

The request must be made within 30 days of the purchase date.

You must have genuinely participated in or reviewed the program materials.

Once the refund is approved, funds will be returned to the original payment method within 5–10 business days.

4.3 Cancellation:
You may cancel access to any recurring or subscription-based service at any time from your account settings or by contacting support.
Upon cancellation, access will remain active until the end of the current billing period, and no further charges will be made.

4.4 Exceptions:
Refunds may not apply to:

Completed one-on-one coaching sessions already delivered.

Programs purchased through third-party platforms (which may have their own refund terms).

5. Health & Fitness Disclaimer

5.1. The Site and Services are for informational and educational purposes only.
They are not a substitute for medical advice, diagnosis, or treatment.

5.2. You should consult your physician or qualified health professional before beginning any new exercise, nutrition, or wellness program.

5.3. Participation in physical activity involves inherent risks. You voluntarily assume full responsibility for any injuries, damages, or losses that may result from your participation.

6. Intellectual Property

6.1. All content on this Site—including text, videos, graphics, logos, and digital materials—is the intellectual property of Confident & Strong or its licensors, protected under copyright and trademark laws.

6.2. You are granted a personal, non-transferable, non-exclusive license to use materials solely for your own personal learning.

6.3. You may not copy, distribute, modify, resell, or create derivative works from our content without written permission.

7. User Conduct

You agree not to:

Use the Site for unlawful, misleading, or harmful purposes.

Upload or transmit viruses or malicious code.

Copy or redistribute our content or materials without authorization.

Use the Site to harass, abuse, or threaten others.

Attempt to gain unauthorized access to the Site or related systems.

8.1. To the fullest extent permitted by law, Confident & Strong and its owners, employees, agents, and partners shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or Services.

8.2. Our total liability to you shall not exceed the total amount paid by you in the 12 months preceding the claim.

8.3. In Mexico, consumer rights are protected under the Ley Federal de Protección al Consumidor (Federal Consumer Protection Law). Nothing in these Terms seeks to limit those statutory rights.

9. Indemnification

You agree to indemnify and hold harmless Confident & Strong, its affiliates, employees, and partners from any claims, liabilities, losses, or expenses (including legal fees) arising from your use of the Site, violation of these Terms, or infringement of third-party rights.

10. Privacy & Data Protection

Your personal information is handled in accordance with our Privacy Policy, compliant with the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP) and applicable international data protection standards.
By using the Site, you consent to our collection and processing of your data as outlined therein.

11. Third-Party Links

Our Site may contain links to third-party websites or services that are not owned or controlled by us.
We are not responsible for the content, privacy practices, or accuracy of information on such third-party sites.

12. Termination

13. Governing Law & Jurisdiction

13.1. These Terms are governed by the laws of the United Mexican States (Mexico).
13.2. Any dispute shall be subject to the exclusive jurisdiction of the competent courts located in Guadalajara, Jalisco, Mexico.
13.3. Users located in Mexico may also seek mediation or file consumer complaints with PROFECO (Procuraduría Federal del Consumidor).

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
